General Terms

1. Trader identification

These General Terms govern the relationship between ERGI Ltd. (ЕРГИ ЕООД), Company ID (ЕИК) 208774195, VAT № BG208774195, registered address: 36 Klokotnitsa Str., fl. 5, ap. 8, Sofia 1233, Bulgaria (hereinafter "ergi.bg" or "the Trader"), and users of the online store at https://ergi.bg (hereinafter "Customer" or "User").

2. Definitions

  • Site — the online store at https://ergi.bg.
  • Goods — handmade jewellery and accessories offered on the Site.
  • Order — an electronic purchase request submitted by the Customer.
  • Distance contract — a contract within the meaning of Article 45 of the Bulgarian Consumer Protection Act, concluded between the Trader and the Consumer in an organised distance-sales scheme.

3. Who may place orders

Orders may only be placed by natural persons aged 18 years or older with full legal capacity. The Site does not serve sales to legal entities.

By placing an order, the Customer declares that:

  • they are 18 years of age or older;
  • they have read and accept these General Terms;
  • they have read the Privacy Policy of ergi.bg;
  • the data they provide for order and delivery is accurate.

4. Product and material information

ergi.bg offers handmade ornaments and accessories. Main materials:

  • Body of the item: plexiglass (acrylic), wood, medical (surgical) steel, glass.
  • Additional components (chains, clasps, earring hooks): silver, medical steel, glass.

Not used: gold, gold plating, platinum, precious or semi-precious stones.

Product photos are illustrative. Due to the handmade nature, slight differences in colour, pattern or texture between individual items are possible — this does not constitute a defect.

4.1. REACH compliance

ergi.bg selects suppliers who declare compliance with applicable European legislation regarding the safety of items in skin contact, including Regulation (EC) No 1907/2006 (REACH). Due to the handmade nature of production and the variety of suppliers, ergi.bg does not provide an individual REACH declaration for each specific component.

4.2. Allergy notice

Items may contain small amounts of nickel in metal components (clasps, earring hooks, chains). Persons with nickel hypersensitivity may experience allergic reactions on prolonged skin contact. At the first sign of reaction (redness, itching) we recommend immediate cessation of use and, if necessary, consulting a doctor.

5. Technical steps for concluding the contract

  1. The Customer selects a product from the catalogue and adds it to the cart.
  2. The Customer reviews the cart and may correct quantities or remove items.
  3. The Customer proceeds to checkout, enters delivery and (optionally) billing information, and selects a delivery and payment method.
  4. The Customer reviews the order summary and confirms acceptance of these General Terms.
  5. The order is submitted by clicking the "Place Order" button (or equivalent). Until that point, the Customer may freely correct any data.
  6. ergi.bg sends an email confirmation containing the order details. This confirmation constitutes the conclusion of the contract.

The contract is concluded in Bulgarian and stored electronically by ergi.bg. Access to the contract content is via the confirmation email and through the user account (if any).

6. Prices and currency

All prices on the Site are quoted in euros (EUR) with VAT included at 20%. Until 9 August 2026, prices are also displayed in Bulgarian leva (BGN) at the fixed rate of 1 EUR = 1.95583 BGN. The dual-currency display is purely informational; payments are processed in EUR.

Delivery costs are added to the order total and shown in the cart and at checkout before final confirmation.

7. Promotions and reduced prices

When a reduced price is announced, ergi.bg displays — in accordance with Article 6b of the Bulgarian Consumer Protection Act and Directive (EU) 2019/2161 — the lowest price applied to that product over the 30 days preceding the reduction.

8. Delivery

8.1. Delivery zones

We deliver only within the territory of the Republic of Bulgaria. International delivery is not offered.

8.2. Delivery methods

  • Speedy — to a Speedy office or to a specified address.
  • BoxNow — to a BoxNow locker chosen by the Customer.

8.3. Dispatch times

ergi.bg dispatches orders within 5 working days from order confirmation. Actual transit time depends on the chosen courier and destination.

8.4. Delivery cost

Delivery cost is calculated according to the courier's tariff and shown at checkout. Free delivery applies for orders of EUR 50 or more, regardless of the delivery method.

9. Payments

Available payment methods depend on the chosen delivery method:

We do not accept bank transfers or PayPal.

Online card payments are processed by BORICA AD. Card data is entered on a secure BORICA hosted page and does not reach the ergi.bg servers. For cash on delivery or card-at-courier — the financial operation is processed by Speedy AD.

10. Right of withdrawal (distance contract)

In accordance with Article 50 of the Bulgarian Consumer Protection Act, the Consumer has the right to withdraw from the contract within 14 calendar days from the day of receipt of the goods, without paying any compensation or penalty and without stating a reason.

10.1. How to exercise the right

To exercise the right of withdrawal, inform ergi.bg of your decision before the 14-day period expires by:

  • email to office@ergi.bg;
  • filling in the standard withdrawal form (Annex 6 to Articles 47(1)(8) and 52(2) and (4) of the Bulgarian CPA), available on the Return Policy page.

10.2. Return period and method

The goods must be returned within 14 days of notification. Return address: 36 Klokotnitsa Str., fl. 5, ap. 8, Sofia 1233, Bulgaria.

10.3. Return cost

In accordance with Article 55(2) of the Bulgarian CPA — the cost of returning the goods upon withdrawal is borne by the Customer.

10.4. Refund

ergi.bg refunds the full amount paid, including the cost of initial delivery (if any), within 14 calendar days from receipt of the returned goods. By default, the refund is made by the same method used by the Customer (card → same card; etc.). By exception, with the Customer's express written consent, the refund may be made to an IBAN provided by the Customer.

10.5. Exceptions — custom orders

Custom-made items may be produced upon individual request. The right of withdrawal does not apply to such items pursuant to Article 57(3) of the Bulgarian CPA, as they are made to individual specifications and are not suitable for resale. This rule applies only with explicit written confirmation of the custom nature of the order from the Customer and after production has commenced. Standard catalogue items remain subject to the general right of withdrawal.

11. Statutory warranty and conformity (defects)

The Customer is entitled to a statutory guarantee of 2 (two) years from the date of receipt of the goods, in accordance with Article 112 of the Bulgarian CPA and Directive (EU) 2019/771. No separate commercial guarantee is provided beyond the statutory one.

11.1. Returns due to defect or non-conformity

If the goods received are defective, the Customer must notify ergi.bg promptly and return the goods according to instructions. The full amount paid will be refunded for any product found to be defective. Return shipping costs for defective goods are borne by ergi.bg.

11.2. Warranty exclusions

The warranty does not cover:

  • Normal wear and tear, including:
    • Scratches on plexiglass and glass from daily use
    • Tarnishing (oxidation) of silver elements (clasps, hooks, chains) — a natural process, not a defect; can be removed with proper cleaning
    • Fading or colour change of wood elements from prolonged exposure to direct sunlight
  • Damage from improper use or storage (high humidity for wood elements, high temperature for plexiglass, storage without a separate box/pouch)
  • Mechanical impact — breakage, deformation, cracking of plexiglass, wood or glass elements
  • Breakage of chains, clasps or earring hooks from sudden load
  • Contact with aggressive chemicals — perfumes, lotions, cosmetics, chlorinated or sea water, household chemicals, solvents
  • Repairs or modifications performed by third parties

12. ergi.bg's right to refuse or cancel an order

ergi.bg reserves the right to refuse performance or cancel an order in the following cases:

  1. Where the ordered goods are out of stock and cannot be delivered within a reasonable time;
  2. Where the catalogue or offer contains an obvious technical error regarding price, description or characteristic of the goods;
  3. On reasonable suspicion of misuse, breach of these General Terms, or provision of false data by the Customer;
  4. Where there is an objective inability to perform the contract for reasons beyond ergi.bg's control.

In all such cases ergi.bg will notify the Customer immediately and refund the full amount paid within 14 calendar days of notification, by the same method used by the Customer.

13. Invoicing

An invoice for an order is issued only at the explicit written request of the Customer, sent to office@ergi.bg within 5 days of the order date (Article 113(6) of the Bulgarian VAT Act). The request must specify: the order number and the name/address of the invoice recipient. The invoice is sent in PDF format by email.

14. Intellectual property

All content of the ergi.bg website — including, but not limited to, text, product photos, graphics, logo, name, original jewellery and accessory designs, video and overall look — is the exclusive property of ERGI Ltd. (ЕРГИ ЕООД). It is protected by the Bulgarian Copyright and Related Rights Act, the Trademarks and Geographical Indications Act, and applicable European legislation.

All product photos are produced by ERGI Ltd.. Jewellery and accessory designs are original works protected by copyright from the moment of creation, without need of registration (Article 3 of the Bulgarian Copyright Act).

Without explicit written consent from ERGI Ltd., the following are prohibited:

  • reproduction, copying and downloading (other than for personal non-commercial use);
  • distribution, alteration, translation, public performance;
  • use of photos, designs or site elements in other commercial or non-commercial contexts;
  • use of the name "ergi.bg", the logo or similar marks that could mislead as to the origin of the goods.

In case of infringement, ERGI Ltd. will pursue all available legal remedies, including cessation of the infringement and damages.

15. Personal data

The processing of Customers' personal data is governed by the Privacy Policy, which forms an integral part of these General Terms.

16. Disputes and applicable law

16.1. Out-of-court dispute resolution

In the event of a dispute, the Customer may contact ergi.bg at office@ergi.bg. We commit to reviewing each request within a reasonable time and proposing a solution in good faith.

If the dispute cannot be resolved out of court, the Customer may turn to the following bodies:

16.2. Jurisdiction

Bulgarian law applies to all matters not governed by these Terms. Disputes that cannot be settled by the above means are subject to the competent Bulgarian court at the Trader's seat — Sofia District Court (for claims up to BGN 25,000) and Sofia City Court (for claims above BGN 25,000).

17. Amendments

ergi.bg reserves the right to update these General Terms. The current version is always available on this page and applies to all new orders from the date of publication. For orders already placed, the General Terms in force at the time of submission apply.

18. Final provisions

If any clause of these General Terms is declared null or unenforceable, the remaining clauses shall continue in force. These General Terms enter into force on the date specified at the beginning of the document.
